Abstract

This research adopts a normative juridical method focusing on the analysis of legal norms and their practical application within the criminal justice system concerning the crime of human trafficking. This approach is selected because the object of the study does not emphasize empirical societal behavior, but rather examines statutory regulations, legal principles, and court decisions that reflect the implementation of legal norms following the ratification of the Palermo Protocol. A statutory approach is employed to examine relevant international and national legal instruments, particularly the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children (the Palermo Protocol), Law Number 21 of 2007 on the Eradication of the Crime of Human Trafficking, and Law Number 14 of 2009 concerning the Ratification of the Palermo Protocol. This approach aims to assess the degree of alignment (harmonization) between international obligations and national legal regulations. In addition, this study applies a case approach by analyzing several court decisions related to human trafficking cases in Indonesia. Court decisions are treated as primary legal materials because they reflect how judges interpret and apply legal provisions on human trafficking in criminal justice practice. The analysis focuses on judicial considerations, the evidentiary proof of the elements of human trafficking, sentencing, and the protection of victims. Secondary legal materials consist of academic journals, legal textbooks, and official reports from national and international institutions such as the United Nations Office on Drugs and Crime (UNODC). All legal materials are analyzed qualitatively using descriptive-analytical and evaluative techniques to produce systematic and comprehensive conclusions.
