ANALYSIS OF DIVERSION PRACTICES FOR CHILDREN IN CONFLICT WITH THE LAW IN THE MEDAN DISTRICT COURT IN 2024

This study analyzes the practice of diversion for children in conflict with the law at the Medan District Court in 2024. The purpose of the study is to evaluate the effectiveness and identify obstacles in the implementation of diversion, a restorative mechanism based on the Juvenile Criminal Justice System Law (UU SPPA). The method used is a literature review with a qualitative descriptive-analytical approach. The results of the study indicate that the implementation of diversion practices at the Medan District Court is not yet fully optimal. The implementation of diversion still faces various obstacles, such as a lack of understanding and coordination among law enforcement officials, the existence of social stigma against children, and limited rehabilitation facilities. The conclusions of this study emphasize the need to increase the capacity of officials, broader socialization, and strengthened coordination between institutions to ensure that diversion can achieve its goals of providing protection and restorative justice for children.
