A RESTORATIVE JUSTICE BASED LEGAL CLINICAL EDUCATION MODEL IN RESOLVING CASES OF CHILDREN IN CONFLICT WITH THE LAW
Abstract
The handling of Children in Conflict with the Law (ABH) in Indonesia is based on the principle of Restorative Justice, which is realized through the Diversion mechanism, as mandated by the SPPA Law. The goal is recovery and reintegration, not punishment, to ensure the best interests of the child. However, implementation in the field is hampered by internal factors (sectoral egos of officials) and external factors (victim rejection and lack of public understanding). To bridge the gap between norms and practice, this study uses normative legal methods with descriptive analysis of secondary legal materials aimed at formulating educational solutions. This Restorative Justice-Based Legal Clinical Education Model is designed to equip prospective legal practitioners with the ethics of the Best Interests of the Child and restorative mediation skills, ensuring they become competent and empathetic professionals, and able to implement restorative justice effectively for ABH.
