Abstract

Drug abuse in Indonesia remains a serious problem, resulting in social, legal, and public health impacts. In the context of law enforcement, 2024 shows an increasing trend in the implementation of alternative punishments in the form of rehabilitation for drug abusers. This policy marks a paradigm shift in criminal law from a repressive approach to a more rehabilitative and humane one, by positioning addicts not only as perpetrators but also as victims in need of recovery. This study aims to analyze the trend in the application of rehabilitation in drug cases in Indonesia in 2024 and assess its effectiveness and challenges. The method used is a normative juridical approach with a qualitative approach, supported by secondary data from laws, court decisions, and BNN policy reports. The results show that rehabilitation is a form of criminal law reform that aligns with the principles of restorative justice, although it still faces obstacles such as limited facilities, regulatory inconsistencies, and lack of coordination between institutions. Therefore, policy harmonization and integrated oversight are needed so that rehabilitation truly functions as an instrument of recovery, not an escape from legal responsibility.
