HUMANIST APPROACH TO LEGAL CLINICAL EDUCATION: A STUDY OF LAW STUDENTS' ETHICS AND EMPATHY

Abstract

 

Penelitian ini bertujuan untuk menganalisis penerapan pendekatan humanis dalam pendidikan klinis hukum, dengan fokus pada penguatan nilai etika dan empati mahasiswa hukum. Permasalahan utama yang diangkat adalah rendahnya sensitivitas sosial dan empati mahasiswa terhadap persoalan keadilan dan kemanusiaan dalam praktik hukum, yang seringkali disebabkan oleh pola pembelajaran yang terlalu teoritis dan kurang mengedepankan aspek kemanusiaan. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus pada kegiatan klinik hukum di salah satu fakultas hukum di Indonesia. Data diperoleh melalui wawancara mendalam, observasi kegiatan klinis, serta analisis dokumen pembelajaran. Hasil penelitian menunjukkan bahwa pendekatan humanis mampu meningkatkan kesadaran etis mahasiswa dan membentuk kemampuan reflektif terhadap posisi mereka sebagai calon penegak hukum yang berkeadilan. Melalui interaksi langsung dengan masyarakat dan bimbingan etis dari dosen pembimbing, mahasiswa belajar memaknai hukum bukan hanya sebagai aturan normatif, tetapi juga sebagai sarana kemanusiaan untuk melindungi hak-hak individu. Kesimpulannya, pendidikan klinis hukum dengan pendekatan humanis efektif dalam menumbuhkan empati, tanggung jawab moral, dan profesionalisme mahasiswa hukum, sehingga perlu diterapkan secara berkelanjutan dalam kurikulum hukum di Indonesia.
