Abstract

Climate change has become a major issue affecting environmental stability and human security worldwide. Rising sea levels, extreme weather events, and environmental degradation have increasingly contributed to population displacement, leading to the emergence of climate refugees. However, international law has not yet formally recognized climate refugee within the existing refugee protection framework, resulting in significant legal uncertainty and inadequate protection mechanisms. This study aims to analyze the legal status of climate refugees under international law and examine the forms of international legal protection available for climate-displaced people. This research uses international conventions, books, journals, and legal cases as primary sources. The findings indicate that the 1951 Refugee Convention remains insufficient to address climate-induced displacement, while human rights law currently serves as the primary basis for protection. Therefore, specific international legal instruments are needed to ensure clearer legal recognition and protection for climate refugee.
